TERMS OF SERVICE

Fingersoft Store (the “Fingersoft Store”) is a website owned and controlled by Fingersoft Oy. (“Fingersoft”, “us”, “we”, or “our”) offering merchandise for sale.

There Terms of Service (“Terms”) shall apply between you and Fingersoft in relation to sale and purchase of any goods or services offered in the Fingersoft Store.

1 Definitions

1.1 Items means the goods and services detailed on the applicable Order Form or any alternative goods or services supplied to you pursuant to these terms.

1.2 Order means your offer to purchase Items from the Fingersoft Store.

1.3 Order Form means the form completed by you online when you order the Items (e.g. the final content of your shopping cart when making an Order).

1.4 Website means shop.fingersoft.com

  1. PLACING AN ORDER

2.1 An Order can be placed by first browsing the Website and selecting your chosen Items, followed by completing the Order Form following the instructions detailed on the Website. 

2.2 After completing and submitting the Order Form, you will receive an email confirming your Order and an associated order number. No agreement on a purchase exists between you and us before you have received this email. 

  1. PRICE

3.1 The price of the Items shall be the price quoted by the Fingersoft Store on the Website next to the illustration or description of the Items. 

3.2 Local taxes or fees, such as value added tax or sales tax, may be added to the quoted value depending on your location. 

3.3 The price is exclusive of any postage and packaging costs. Delivery charges will be set out on the Website and will vary depending on the delivery location of the Items. 

3.4 An additional charge may be placed depending on your payment method. The price will be set out on the Website before finalizing your order.

 

3.5 In the event of a discrepancy between prices displayed on the Website, the price displayed on the Order Form shall prevail.

3.6 Fingersoft Store reserves the right to alter the prices on the Website at any time. If any price is altered after a Purchase is made, the price displayed in the order confirmation shall apply. 

  1. PAYMENT 

4.1 The amount payable by you shall be the total price of the Items and the applicable delivery charges. The total amount payable by you in respect of the Items and delivery of them will be shown to you before you submit the Order. 

4.2 Available payment methods are displayed on the Website. Fingersoft reserves the right to alter the available payment methods. Please note that we will never accept payment by cash or check.

  1. AVAILABILITY AND DELIVERY

5.1 Most of the Items displayed on the Website are stored in limited quantities and delivery may require producing them based on your Order. An estimated delivery time will be provided to you on the Website. 

5.2 Please ensure that the delivery address provided by you is correct, as failing to do so may cause delay in delivery or incur additional costs. 

  1. NON-DELIVERY
    6.1 If the Items have not been delivered to you within 14 days of the latest delivery date displayed on the Website when making the Order, you have the right to (a) cancel the order; or (b) choose alternative Items displayed on the Website up to the same value of the Items in your original Order, provided that you agree to return or purchase the original Items in case they are delivered at a later date.

6.2 Please contact Fingersoft at shopsupport@fingersoft.com for more information in case of non-delivery.

6.3 Any liability of Fingersoft Store for non-delivery of the Items shall be limited to replacing the Items within a reasonable time or issuing a refund.

6.4 If for any reason, other than exercising your return right, you do not accept delivery of the Items or Fingersoft is unable to deliver the Items on time because you have not provided appropriate instructions, such as providing the correct delivery address, Fingersoft may either (a) store the Items until delivery whereupon you will be liable for all related costs and expenses, or (b) refund the Items less by delivery costs.

  1. REFUND AND EXCHANGE POLICY
    7.1 If you are a consumer in accordance with applicable laws, you have the right to return or exchange any Items purchased from the Website without providing a specific reason. Such returns can be made by notifying us of your intention within 14 days from receiving the Items. 

7.2 Fingersoft will give you a full refund for the price you paid for the Items, provided that the Items are returned to Fingersoft in their original condition, in their original packaging (where possible) and the Items are not considered non-refundable. Non-refundable Items are:

  1. for hygienic reasons: underwear, socks, swimwear, earrings, body jewelry, cosmetics or face masks of which the packaging seal has been opened;
  2. personalized items, such as Items that have been altered to your instructions; or
  3. special made-to-order Items, such as time or quantity limited Items.

7.3 Defective Items. If the Items do not match their description on the Website, are incorrect, defective, faulty or damaged (“Defective”) you have a right to request a new Item by notifying Fingersoft about the Defect within 14 days from your receiptance of the Items or within 14 days after you noticed the defect (or you should have noticed it) by sending an email to shopsupport@fingersoft.com and sending at least:

a) your Order ID

b) your delivery address

c) at least two clear pictures of the fault/defect

d) a description of the error briefly.

After receiving your notification, Fingersoft will process the notification and ship a new product matching the faulty one within 30 days of receiving the complaint. 

Returns

7.4 If you wish to return any Items, it is required that you send us a notification within 14 days from your receipt of the Items to shopsupport@fingersoft.com. The notification should include the order number of the original purchase and your shipping address. 

7.5 You have to return the Items within 14 days from delivering us a return notice. 

7.6 Returned Items should be sent to the returns address sent to you by the customer service or to the address provided with your Order.

7.7 To ensure the receipt and timely processing of your Items, please enclose with the return a slip with the original order number. We encourage you to use delivery with a tracking service in order to avoid late or missing delivery.

7.8 If you wish to return any Items which are not Defective, you are solely liable for any delivery costs of the return.

7.9 When you return Items to us and you request a refund, we will issue a refund as soon as possible, and no later than 30 days after we have received your returned package. 

7.10 Please note that refunds can only be made to the original purchase method provided at the time of checkout. Refunds cannot be made to alternative payment methods, new cards or accounts. Please contact your payment processors or bank for information about how to receive refunds from online purchases made with cards or from accounts that are no longer active.

7.11 If we are unable to process a refund to your original payment method, Fingersoft may offer store credit via a gift card.

 

  1. CANCELLATION POLICY
8.1 You have the right to cancel your Order before the ordered Items have been shipped. Ordered items that are made to order or made specific to your instructions may not be cancelled after they have been produced, even if they have not been shipped prior to cancelling. If an Order has been shipped, you may follow our return policy for a refund, if available. Please note that an item may be produced or shipped before our customer support has a chance to process your cancellation.

8.2 To cancel your order in accordance with this Cancellation Policy, please contact us by email at shopsupport@fingersoft.com.

  1. RISK AND PROPERTY 

9.1 Risk of damage to, or loss of the Items will pass to you upon delivery of the Items. 

9.2 Ownership of the Items will not pass to you until Fingersoft has received in full all sums due to it in respect of the Items and all other sums which are or which become due to Fingersoft. 

9.3 If you intend to return or exchange any Items, you must keep good care of the Items pending their return to Fingersoft. Used, worn or otherwise unfit for sale items may not be refunded or returned.

  1. LIMITATION OF LIABILITY

10.1 Fingersoft warrants that it has the right to sell the items that it has available for sale on the Website. All other warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from any agreement between Fingersoft and you. 

10.2 Fingersoft’s liability under these Terms shall be limited to the aggregate amount paid by you for the Order which the cause of action arises. 

10.3 Nothing in these Terms excludes or limits the liability of Fingersoft for fraudulent misrepresentation or death or personal injury caused by the negligence of Fingersoft or its employees or your statutory rights as a consumer.

  1. GENERAL

11.1 You should read these Terms and our Store Privacy Policy before browsing or making Orders through the Website.

11.2 If for any reason a court finds any provision of these Terms to be invalid or unenforceable, then these Terms shall continue in force excluding for those parts of the invalid or unenforceable provision that have to be deleted to enable the remaining parts, and the other provisions, to be valid and enforceable. Where possible, a provision as close to the original but enforceable under law shall be considered to apply.

11.3 Failure or delay by Fingersoft in enforcing or partially enforcing any provision of these Terms will not be construed as a waiver of any of its rights under them. 

11.4 Any waiver by Fingersoft of, or any default under, any provision of these Terms by you will not be deemed a waiver of any subsequent breach or default and will in no way affect the other terms of these Terms.

11.5 Fingersoft reserves the right to defer the date of performance or cancel any Order under these Terms without liability to you if it is prevented from or delayed in the carrying on of its business due to circumstances beyond Fingersoft’s reasonable control. If the event in question continues for a continuous period in excess of 14 days, you shall be entitled to give written notice to Fingersoft to cancel such agreement and obtain a refund of any sums paid.

11.6 Any notice required to be given to Fingersoft shall be in writing and sent by post to Aleksanterinkatu 4-6, 90100 Oulu, Finland or by email to shopsupport@fingersoft.com unless otherwise notified. Any notice required to be given to you by Fingersoft shall be in writing and sent by post or email to the addresses that you provided when ordering the Items, unless otherwise notified. 

11.7 You agree with Fingersoft that any agreement made under these Terms is exclusively between you and Fingersoft and it is not intended to be enforceable by any other person who is not a party to it. 

11.8 These Terms shall be governed by Finnish law. Unless otherwise provided by mandatory provisions of applicable consumer protection legislation, you and Fingersoft submit to the non-exclusive jurisdiction of the Finnish Courts. 

11.9 Any agreement between you and Fingersoft is made under these Terms, and includes, the descriptions of the Items as provided by us on our Website, the Order Form, Shipping Policy and the Privacy Policy. Together these constitute the entire agreement and understanding of you and Fingersoft and supersede any previous agreement between the parties relating to the subject matter of such agreement. Nothing in this clause shall operate to limit or exclude any liability for fraudulent misrepresentation. 

11.10 You acknowledge that Fingersoft may change these Terms from time to time.
